Washington D.C. Challenges Trump’s Takeover of Local Police in New Lawsuit

The government of Washington D.C. has launched a legal challenge against President Donald Trump's recent emergency order that placed the city’s police department under federal control. This dramatic step was taken after the Trump administration declared a crime emergency in the nation's capital earlier this week.

The administration's move came on August 11, when Trump utilized emergency powers granted by Section 740 of the DC Home Rule Act. This section allows the president to assume authority over local police in situations deemed as emergency conditions. The cited reason for this action was a significant uptick in violent crime within the city.

Following the declaration, U.S. Attorney General Pam Bondi issued directives that were quickly implemented, including the appointment of Terry Cole, the head of the Drug Enforcement Administration, as the emergency police commissioner. This appointment handed Cole complete control over the police force, effectively nullifying several existing policies, notably those related to sanctuary city protections.

In response, D.C. Attorney General Brian L. Schwalb filed a complaint to the US Federal District Court for DC, arguing that the Trump administration's actions overstep legal boundaries and infringe upon constitutional principles that guarantee local self-governance.

Attorney General Schwalb expressed his concerns in a poignant statement, highlighting the severity of the federal government’s actions: “By declaring a hostile takeover of MPD, the Administration is abusing its limited, temporary authority under the Home Rule Act, infringing on the District’s right to self-governance and putting the safety of DC residents and visitors at risk. The Administration’s unlawful actions are an affront to the dignity and autonomy of the 700,000 Americans who call DC home. This is the gravest threat to Home Rule that the District has ever faced, and we are fighting to stop it.”

The lawsuit seeks a judicial declaration that the federal takeover is unlawful, aiming to revert control of the police force back to local authorities. This move underscores a significant clash between federal powers and local autonomy, setting the stage for a potentially landmark legal battle concerning the limits of presidential emergency powers and the right of cities to self-governance.
