The American Bar Association (ABA) has issued a strong rebuke against what it perceives as political interference by the Department of Justice (DOJ), emphasizing the need for prosecutorial decisions to be made without political influence. The national professional organization for lawyers in the US took this stand in a statement released on Friday, which criticized the use of government power to intimidate political opponents and officials who are merely fulfilling their duties.
The statement declares, "Using government power to threaten people and groups on political grounds is antithetical to our system of justice and the rule of law. Intimidating a political opponent, a lawyer or law enforcement official who was doing their job, an organization that pursued missions not favored by the president, state attorneys general and even members of Congress is unacceptable. Evidence, not ideology, should always be the north star."
This proclamation comes at a time when the ABA's role in legal education is under scrutiny. Recently, Texas announced its decision to cease recognizing the ABA’s accreditation of law schools, a move followed by Florida's review of the ABA's political engagements. The ABA has been the sole federally recognized accreditor of American law schools since 1952, with many states requiring graduation from an ABA-accredited law school as a prerequisite for bar admission.
The ABA's statement also references historical and constitutional safeguards designed to preserve the impartiality of the judiciary, including Article II, Section 2, Clause 2 of the US Constitution. This clause emphasizes the role of the Senate in confirming presidential appointments to curb undue political influence in judicial appointments.
Moreover, the statement comes in the backdrop of the indictment of former FBI director James Comey, who has alleged that the charges against him for making false statements to Congress and obstruction of justice are politically motivated attacks by the DOJ under President Donald Trump.
