Amnesty International released a damning report on Wednesday, claiming that Chinese courts are systematically repressing civilians through the misuse of ambiguous laws, leading to violations of freedom of speech and association. The report, titled "How Could This Verdict be 'Legal'?", is based on an analysis of more than 100 official indictments and verdicts from 68 cases over the past decade. It asserts that every case reviewed demonstrated breaches of fair trial rights, including arbitrary detentions and allegations of torture.
The findings reveal a judicial system that functions more as an instrument of repression than as a beacon of justice, particularly in politically sensitive cases. Sarah Brooks, Amnesty International’s China Director, has called for the immediate and unconditional release of all activists and civilians jailed for exercising their fundamental rights. “Chinese courts operate as tools of repression rather than pillars of justice," Brooks stated, highlighting the gravity of the situation.
The report criticizes the Chinese judiciary for "rubber-stamping" convictions against individuals based on their views, words, and associations. It notes that the majority of those arrested are human rights activists, journalists, and lawyers—individuals who often engage with the international community or openly critique the government. Recent crackdowns on lawyers are particularly concerning, undermining the legal profession’s crucial role in safeguarding human rights.
Furthermore, the report details how arrests and charges are frequently made under vague national security and public order provisions, such as "subversion of state power", "inciting subversion", and "picking quarrels". Even online activities like commenting on blog posts or sharing articles about human rights are being treated as acts of "subversion".
Trials are often shrouded in secrecy, closed off to families and media "under the guise of state secrets", even when the charges do not involve classified information. The report also highlights instances where activists are sentenced to additional "deprivation of political rights", preventing them from engaging in dissent even after their release.
These actions stand in stark contrast to the protections outlined under international law, specifically the International Covenant on Civil and Political Rights (ICCPR), which safeguards the right to a fair trial, and the rights to freedom of expression and association.
Amnesty International's report serves as a crucial reminder of the ongoing challenges in safeguarding fundamental human rights in environments where legal systems are wielded as tools of political repression. The organization continues to urge the global community to take notice and respond to these serious allegations of human rights abuses.
