UN Human Rights Experts Decry Disbarment of Hong Kong Lawyer Kevin Yam as Reprisal for Speaking Out

UN human rights authorities have issued a strong condemnation against the punitive measures taken against Hong Kong solicitor Kevin Yam, whose professional credentials and financial stability were targeted following his candid remarks about the city’s judicial independence. The sanctions against Yam, which include his disbarment and the imposition of financial penalties, have been criticized as retaliatory actions for his testimony at a US Congress hearing in May 2023.

The disbarment, executed on 16 July 2025, was carried out despite Yam not violating any rules set forth by the Hong Kong Law Society or its Code of Conduct. The proceedings were conducted by a tribunal directly appointed by the Chief Justice, raising concerns about the impartiality and fairness of the judicial process in Hong Kong.

This punitive action against Yam is seen as part of a broader pattern of retaliation against legal professionals in Hong Kong who dare to address or critique the rule of law under the increasingly stringent National Security Law imposed by Beijing in 2020. International observers and rights groups have noted a disturbing trend of freedoms being curtailed under the law, which has significant implications for the legal community and freedom of expression in Hong Kong.

In their statement, the UN experts highlighted the critical nature of the situation, stating, "This is a new retaliation and an alarming assault on freedom of expression and lawyers’ rights to practice their profession and express their views in line with international standards. This attempt to silence lawyers by disbarring them is an appalling violation of international law and sets a very troubling precedent in Hong Kong and China."

They further emphasized that under the UN Basic Principles on the Role of Lawyers, legal professionals must be allowed to perform their professional functions without facing improper interference, threats, or intimidation. Since Hong Kong is a part of China, these principles are applicable and enforceable under China's membership in the United Nations and its commitment to uphold international legal standards.

The case of Kevin Yam has been formally brought to the attention of the Chinese government by the UN experts, underscoring the international concern and the call for a reassessment of the measures taken against him. The international community continues to watch closely, as the treatment of lawyers in Hong Kong could set significant legal precedents that affect the rule of law and human rights in the region.
