Nonprofit Sues FBI and DOJ Over Withheld Bribery Probe Video

In a bold legal move, Democracy Forward, a Washington, D.C.-based nonprofit organization dedicated to promoting government transparency, has filed a lawsuit against the US Department of Justice (DOJ) and the Federal Bureau of Investigation (FBI). The legal action, initiated on Monday, centers on the agencies' refusal to release video evidence tied to a bribery investigation involving Tom Homan, former director of Immigration and Customs Enforcement (ICE) and the current "White House Border Czar."

Tom Homan came under federal scrutiny after allegations surfaced in September 2024 that he accepted a $50,000 cash bribe from undercover FBI agents. These agents, posing as business executives, reportedly offered Homan the bribe in exchange for assistance in securing government contracts if the Trump administration were to continue into a second term. Despite these serious allegations, and substantial media interest, the DOJ and FBI concluded their investigation on September 20, stating they found "no credible evidence of any criminal wrongdoing" and subsequently closed the case.

This lawsuit by Democracy Forward highlights a significant public concern regarding the transparency and accountability of federal agencies. The organization argues that withholding the video recording, which allegedly shows Homan accepting the bribe, violates the Freedom of Information Act (FOIA). FOIA mandates that all government agencies must release information upon request unless it falls under specific exemptions designed to protect privacy, national security, and other key interests.

In their legal filing, Democracy Forward seeks judicial intervention to compel the FBI and DOJ to process their FOIA request expeditiously and to release the non-exempt portions of the video recording. The nonprofit contends that the public has a right to view the evidence that led to the closure of such a high-profile investigation.
