In an unusual twist to the high-profile case involving cryptocurrency mogul Sam Bankman-Fried (SBF), his mother, Barbara Fried, has been explicitly instructed by Judge Lewis Kaplan to stop filing motions on her son's behalf. The directive came after Fried, a seasoned legal scholar, sought an extension for SBF’s response to a government motion opposing his request for a new trial.
Sam Bankman-Fried, whose legal entanglements have captured public attention, had his bail revoked by Judge Kaplan due to allegations of witness tampering, further complicating his defense. Representing himself, SBF has argued for a retrial, claiming that his cryptocurrency exchange, FTX, was solvent at the time of his initial conviction and that the charges against him were politically motivated.
Barbara Fried, despite her extensive legal background, including a clerkship at the Second Circuit and a long tenure at Stanford Law School, does not represent her son in this case. Her attempt to intervene, according to Judge Kaplan, was out of order as she "lacks standing to file papers or seek relief in this case." Her actions included writing a letter to the judge and leaving a voicemail at his chambers, both of which are highly unconventional and frowned upon in judicial proceedings.
The court’s response to Fried’s overtures was stern, underscoring that communications from litigants or their family members via phone are not accepted, and highlighting the procedural missteps in her approach, such as failing to serve the letter on the U.S. Attorney's office.
Amidst this backdrop, SBF's legal situation remains precarious. He is due for a prison transfer, which could delay his legal battles indefinitely. Recognizing the logistical challenges SBF faces, Judge Kaplan granted a shorter extension than requested, allowing his official legal team to prepare adequately.
The government has dismissed SBF’s claims for a retrial as “fanciful” and “incoherent,” likening them to the volatile nature of cryptocurrencies themselves.
