Unlike typical restorations done by other luxury car manufacturers such as Ferrari or Mercedes-Benz, Porsche’s program includes setting the odometer back to zero.
This practice, however, skirts the edges of legal boundaries. According to the Federal Odometer Act, it is illegal for any person, including manufacturers, to alter an odometer unless the change is made to replace or repair a faulty odometer; and if the exact mileage cannot be preserved, the odometer must be reset to zero with a disclosure of the change attached to the vehicle.
The dilemma arises because Porsche’s reset is not due to a malfunction but as part of a restoration to a "zero kilometer condition." This means, legally, the reset odometer reading must be disclosed to potential buyers to avoid misleading them about the vehicle's actual wear and tear and history. Failing to disclose this fact could lead to a fraud claim if the car is sold as a zero-mile vehicle without mention of its restoration status.
The implications for buyers and sellers are significant. Sellers must be transparent about the car's history to avoid legal repercussions, while buyers need to be vigilant, ensuring they have all the facts about a car’s past before purchasing a restored vehicle, even one as pristine as those from Porsche’s Sonderwunsch program.
Moreover, the issue raises broader questions about the value of such vehicles. Can a factory-recommissioned Porsche command the same price as an original low-mileage car? The market will ultimately decide, but the debate continues as to whether resetting an odometer, even legally, affects a car's authenticity and desirability.
